MyMedRecords ("the App," "we," "us," or "our") is a service operated by Strategic Litigation Partner LP, a litigation support company, that allows an individual ("you" or "Patient") to authorize the release of your health information from your healthcare provider's electronic health record system (including Epic Systems Corporation-based systems, using Epic's FHIR-based Patient Access interfaces) to Strategic Litigation Partner LP, for use in connection with a specific pending or anticipated litigation matter. Strategic Litigation Partner LP is not a law firm, does not provide medical or legal advice, and does not hold attorney-client privilege in its own right. By authorizing the App to connect to your health record, you agree to these Terms and Conditions and this Privacy Policy.
1. Who Should Use This App
This App is intended only for individuals who have been asked by their attorney, or by a party involved in litigation or a legal claim, to authorize release of their health records for use in that specific matter. You should only authorize this App if you understand and intend for your health information to be shared with the law firm and litigation support company identified to you at the time of authorization.
2. How This App Works
When you authorize this App, you will be directed to log in to your healthcare provider's patient portal (such as MyChart) and will see an authorization screen describing the specific categories of health information the App is requesting. This process uses SMART on FHIR / OAuth 2.0 technology, a security standard that lets you grant limited, revocable access to specific data without sharing your portal username or password with us. Your provider — not this App — controls your login credentials at all times.
3. What Information We Access and Collect
Health information from your provider's FHIR-based system, which may include:
- Medical history, conditions, and problem list
- Medications and allergies
- Immunizations
- Laboratory and diagnostic test results
- Procedures and encounter/visit records
- Clinical notes, where made available by your provider through the API
- Billing and insurance information, where applicable
Identifying information needed to match your record and process your authorization, such as:
- Name and date of birth
- Contact information (address, phone, email)
- Information confirming your identity during the authorization process
We access only the data categories you are shown and agree to at the time of authorization. If your provider has not made a particular part of your chart available through the API, we will not be able to access it through this App.
4. How We Use Your Information
We use the information obtained through this App solely for the litigation or legal matter identified to you at the time of authorization, including providing the information to the law firm handling that matter and, where necessary, to litigation support personnel or subcontracted vendors assisting with that matter (such as e-discovery or document review providers).
We do not:
- Use your information for marketing or advertising
- Sell your information
- Use your information for any purpose unrelated to the litigation matter identified to you
- Share your information outside the parties necessary to that matter, except as required by law or court order
5. Your Right to Revoke Access
You may revoke this App's access to your health information at any time by using your provider's patient portal (typically under an "Apps" or "Connected Apps" management setting) or by contacting us directly at info@slplegal.com. Revoking access will stop future data retrieval but will not affect information already retrieved before you revoked access. Revocation of App access does not withdraw any separate written HIPAA authorization you may have signed; if you also wish to revoke a signed authorization, you must do so in writing to the healthcare provider and to Strategic Litigation Partner LP as described in that authorization.
6. Data Security
We use administrative, technical, and physical safeguards designed to protect the confidentiality and security of the health information we access, including encryption in transit and at rest, access controls limiting which personnel can view your information, and audit logging. No method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
7. Data Retention and Deletion
We retain the information obtained through this App only as long as necessary for the litigation matter for which it was obtained, or as required by law, court rule, or applicable record-retention obligations, or as revoked by the patient in writing to Strategic Litigation Partner LP. When no longer needed, information is deleted or securely destroyed, or returned to the law firm or client as directed by the engagement governing that matter.
8. Third-Party Platforms
This App connects to your healthcare provider's electronic health record system using technology made available by Epic Systems Corporation and by your provider. Epic and your provider are not responsible for how this App or its operator uses your information once obtained; that responsibility belongs solely to us. Your use of your provider's patient portal is also subject to that provider's own terms of use and privacy policy.
9. No Waiver of Privilege
Authorizing this App does not waive any attorney-client privilege, work product protection, or other privilege that may apply to communications between you and your attorney regarding the underlying matter.
10. Children and Incapacitated Individuals
This App is not intended for use by individuals under 18 without the involvement of a parent or legal guardian, or by an individual who lacks capacity to authorize release of their own health information. If you are authorizing access on behalf of a minor or another person, you represent that you have the legal authority to do so (for example, as a parent, legal guardian, holder of a power of attorney, or court-appointed representative). 11. Changes to These Terms
We may update this Terms and Conditions and Privacy Policy from time to time; the "Last updated" date above reflects the most current version. Material changes will be posted at https://mymedrecords.slplegal.com/about.
